The Adobe Contractual Licensing Program (CLP) is a volume licensing option. Before placing an order please review both this page and the Ordering Instructions. This information will clarify the program rights and responsibilities. Adhering to the terms and conditions of a software license agreement is called being "in compliance". This means an end user has acquired the proper number of licenses based on the number and type of products that are actually installed. Compliance is an issue that institutions need to be concerned about for this contract.
The licenses or rights granted by Adobe in the End User License Agreement (EULA) to install and use the copy(ies) of the Software and the User Documentation, as such license or right is made available under the Agreement. All licenses acquired under the CLP program, including those granted when an Upgrade Plan is purchased, are perpetual licenses.
In a networked environment users may share access to Adobe products provided that the number of users actually using the software at one time does not exceed the number of licenses the End User currently owns.
End Users have the ability to change single use licenses to concurrent use, through the payment of uplift fee. The licenses must be at the current version before you can purchase the uplift option.
The right for an end user to order, receive and use such updates and patches for the software as may be released during a specific period in return for payment of a license fee. The decision is optional for the end user, but must be made at the time new licenses are purchased. The term of the maintenance is for the two-year contract and ends on February 28, 2010. If an Upgrade Plan is purchased, the end user has rights to the most current version of the product that Adobe has released.
End users may purchase an Upgrade Plan for Concurrent Licenses. The same rights described under Upgrade Plans apply.
The CD set is the physical copy of the software. End users must purchase a set of media for each different product type ordered but not for each license. However, the number of media sets cannot exceed the number of licenses purchased for each product.
The primary end user of each computer on which the Software is installed may also install the Software on one home computer. However, the software may not be used on the home computer at the same time the software on the primary computer is being used. End users MAY NOT resell, rent, lease, sublicense or lend the software.
The software is owned by Adobe. When the end user purchases software they are being granted the right to use the product in agreement with the End User License Agreement (EULA). The most common example of illegal use is copying the software without buying the appropriate number of licenses based on the number of seats the product is installed. In the event of an audit, and if a discrepancy is discovered, the end user must pay a penalty for the number of seats they have under reported.
Adobe has defined the eligible customers under the CLP. All MSU faculty and staff can purchase licenses under this program for their departments. All other groups must contact the MSU Computer Store at 517-432-0700, to determine their eligibility before placing an order. Adobe has the final decision as to whether a group has the right to acquire products under this program. Students are currently not able to purchase products for individual use.
